What is the NDIS Code of Conduct and who must follow it?

The NDIS Code of Conduct sets out the standards of behaviour expected of every NDIS provider and worker, whether registered or not. It is enforced by the NDIS Quality and Safeguards Commission and covers seven core obligations, from respecting rights and privacy to preventing abuse, neglect and sexual misconduct.

Who does the Code apply to?

The Code of Conduct applies broadly. It binds all NDIS providers and the workers who deliver supports, including unregistered providers and self-employed workers, not just registered organisations.

It is enforced by the NDIS Quality and Safeguards Commission, which can investigate breaches and take compliance action where the standards are not met.

What are the seven obligations?

The Code groups expected behaviour into seven duties. Together they protect the dignity, safety and choice of people with disability.

Respect individual rights to freedom of expression, self-determination and decision-making
Respect the privacy of people with disability
Act with integrity, honesty and transparency
Provide supports safely and competently with care and skill
Promptly raise and act on concerns about quality and safety
Take steps to prevent and respond to abuse, neglect, violence and exploitation
Take steps to prevent and respond to sexual misconduct

What can you do if the Code is breached?

If you believe a worker or provider has not met these standards, you can raise it directly with the provider or make a complaint to the NDIS Quality and Safeguards Commission.

Complaints can be made by participants, families, carers, advocates or workers. The Commission reviews concerns and can require corrective action.

How does the Code differ from the Practice Standards?

The Code of Conduct sets minimum behaviour for everyone in the sector. The NDIS Practice Standards are the more detailed quality requirements that registered providers must meet to gain and keep registration. The two work together but are not the same.

Does the Code apply to unregistered providers? +
Yes. Every NDIS provider and worker must follow the Code of Conduct, regardless of whether they are registered with the Commission.
Who enforces the Code? +
The NDIS Quality and Safeguards Commission enforces it. The Commission can investigate breaches and take compliance or enforcement action.
How do I make a complaint? +
You can raise concerns with the provider first, or contact the NDIS Quality and Safeguards Commission directly. Participants, families, advocates and workers can all complain.
What does acting with integrity mean here? +
It means being honest and transparent, declaring conflicts of interest, and being clear about costs and the supports being delivered.
Is the Code the same as the Practice Standards? +
No. The Code sets minimum conduct for all, while the Practice Standards are detailed quality rules that registered providers must meet.
